The Lahore High Court (LHC), Rawalpindi Bench, has declared the collection of MDCAT question papers from candidates after the exam illegal and ordered the Pakistan Medical and Dental Council (PMDC) to upload the papers to its app immediately.
Justice Ahsan Raza Kazmi announced the verdict on petitions filed by students Rehan Shahid and Anabia Tahir, who challenged the practice of taking back question papers once candidates had solved them.
Barrister Imran Afrasiab, representing the petitioners, argued that retaining question papers is the constitutional and legal right of candidates. He termed the practice unconstitutional, illegal and unethical.
Assistant Attorney General Malik Zaheer Arshad appeared on behalf of the federation.
In his ruling, Justice Kazmi held that the PMDC cannot hand question papers to candidates and then take them back. The court directed the council to implement the decision the same day and to publish the question papers of all examinations on its app without delay.
