Court finds Samsung guilty of infringing on 4G patents owned by Huawei

Huawei being the third largest smartphones’ manufacturer has been a tough rival of South Korean giant Samsung in various emerging markets around the world. However, both companies are rarely seen quarreling each other in courts and we are here with a similar sort of story. A Chinese court has given orders that Samsung Electronics Co. Ltd. should stop infringing upon two 4G standard essential patents considered intellectual property rights held by Huawei Technologies Co. Ltd.

Back in 2016, Huawei filed the lawsuits seeking damages from companies that use its patents without proper licensing. As of now, the South Korean company has been found guilty of infringing on two of the 4G standard essential patents related to telecom equipment and technology owned by Huawei. In addition, the Shenzhen Intermediate People’s Court also found that Samsung intentionally delayed negotiations and the South Korean company was considered at fault.

According to the court ruling, the case was one of the most complicated IPR cases around the world and the trial of Samsung lasted for 18 days.

As the court has now ordered Samsung to stop infringing upon Huawei’s 4G technology patents. So the Korean tech giant will have to get a proper license for the patents from Huawei.

Huawei is emerging to be a tough rival for Apple and Samsung, as it has focussed on emerging markets all around the world with its budget-friendly and specs loaded smartphones. Samsung and Apple have a fair share of the market when we talk about sales of flagship phones, but Huawei is killing it with over 100 million phones sold in 2017.
