Sony faces a brand-new lawsuit regarding recent PlayStation 5 price increases and United States tariff changes. In 2025, the Trump administration enacted IEEPA tariffs. Subsequently, the Supreme Court declared these tariffs unconstitutional. Therefore, the government offered companies a method to file claims and refund the tariff costs. This exact mechanism triggered the current legal action against Sony.
Sony Profiting Twice?
A new class-action lawsuit alleges Sony is gaining a significant windfall from these unlawful tariffs. Specifically, the lawsuit claims the company initially raised the price of the PlayStation 5 to compensate for the new tariffs. Now, Sony will receive tariff refunds from the government. However, the company is not passing these refunds along to the consumers who paid the inflated prices.
Consequently, the lawsuit argues that Sony is profiting twice. First, the company profited from the increased cost of the consoles. Second, it profits again from the government refunds. Accordingly, the lawsuit claims all consumers who purchased a PlayStation 5 at the increased price are owed refunds for the extra cost.
A History of Legal Trouble
Sony regularly deals with legal battles. For instance, the company recently ended a monopoly lawsuit. In that case, a preliminary settlement requires the company to pay $7.8 million for allegedly limiting third-party sales. Previously, Sony faced lawsuits over PlayStation Store pricing, an ex-Destiny developer, and controller drift. The courts eventually dismissed the controller drift lawsuit.
Furthermore, this tariff issue extends well beyond Sony. Nintendo currently faces a nearly identical lawsuit regarding its unrefunded tariff money. Similarly, consumers are suing Amazon, Nike, and Adidas for the exact same practices. Meanwhile, shipping giants like UPS and FedEx faced similar legal threats. As a result, those shipping companies promised to route their tariff refunds directly back to impacted customers.
Currently, Sony has not responded to the lawsuit. Therefore, it remains unclear how much money PlayStation fans could expect to receive if the lawsuit succeeds. Ultimately, this implementation of tariffs created a messy situation for the entire market. Whether the company voluntarily issues refunds or fights the lawsuit, resolving this problem will clearly take time.
