The Islamabad High Court (IHC) is scheduled to hear a petition challenging the legality of a fee imposed for entry into the New Blue Area commercial area in the federal capital.
Justice Arbab Muhammad Tahir will preside over the case, which argues the Rs100 service road charge levied by the Metropolitan Corporation Islamabad should be declared entirely illegal and void.
The petition names the home secretary, Islamabad chief commissioner, and Metropolitan Corporation Islamabad administrator as respondents, holding them accountable for the contested fee collection practice.
New Blue Area is home to commercial markets, corporate headquarters, and restaurants, making the service road a high-traffic route used daily by thousands of visitors, workers, and customers.
The petitioner contends the Rs100 charge is not a parking fee but is instead collected from all individuals using the service road, regardless of whether they park there.
The petition further argues the Metropolitan Corporation Islamabad provides no facility, service, or benefit in return for the amount it collects from users of the service road.
It also maintains that imposing an entry fee on a public service road directly violates prior decisions issued by Pakistan’s higher courts on the matter.
The court has been formally requested to declare the fee collection practice unlawful and bring it into compliance with higher court rulings on public road access.
The petition was filed through lawyers Zohaib Gondal, Hazrat Younis, and Hammad Saeed Dar, who are representing the petitioner in this legal challenge.
